EzyGuest Terms and Conditions

These Terms and Conditions (“Terms”) govern the access to and use of the EzyGuest platform and services (“Services”) by hosts (“you”, “Host”) who create an account with EzyGuest (“EzyGuest”, “we”, “us”, “our”). By creating an account, clicking “I agree”, or otherwise using the Services, you agree to be bound by these Terms.

1. About EzyGuest

EzyGuest provides digital guest welcome guides and related tools designed to assist short‑term rental and accommodation hosts in communicating information to guests. EzyGuest does not own, operate, manage, or control any accommodation listings and is not a party to any booking between a Host and a guest.

2. Eligibility and Account Registration

2.1 You must be at least 18 years old and have the legal capacity to enter into a binding agreement.

2.2 You agree to provide accurate, current, and complete information when creating an account and to keep your account information up to date.

2.3 You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

3. Scope of Services

3.1 EzyGuest enables Hosts to generate, host, and share digital guest guides based on information provided by the Host.

3.2 The Services may include templates, automation tools, integrations (including third‑party services such as Google, Canva, or payment providers), and hosted web or downloadable formats.

3.3 We may modify, update, suspend, or discontinue any part of the Services at any time, with or without notice.

4. Host Responsibilities

4.1 You are solely responsible for: – the accuracy, completeness, and legality of all content you submit; – ensuring guest information complies with applicable privacy and data protection laws; – ensuring your guest guides comply with local laws, regulations, strata rules, council requirements, and platform rules (e.g. Airbnb, Booking.com).

4.2 You must not use the Services to: – provide false, misleading, or unlawful information; – infringe intellectual property or privacy rights; – transmit malicious code or misuse the platform; – engage in conduct that could damage EzyGuest’s reputation or systems.

5. Guest Interactions

5.1 EzyGuest is not responsible for: – guest conduct or behaviour; – disputes between Hosts and guests; – property damage, injury, or loss.

5.2 Any agreement, booking, or interaction with guests is solely between you and the guest.

6. Fees, Plans, and Payments

6.1 Certain Services require payment of subscription or usage fees as described on the EzyGuest website or during checkout.

6.2 Fees are billed in advance unless stated otherwise and are non‑refundable except where required by law.

6.3 We may change pricing, plans, or features at any time. Changes will not apply retroactively and will take effect from your next billing cycle.

6.4 Failure to pay may result in suspension or termination of your account.

7. Free Trials and Promotions

7.1 Free trials or promotional offers may be offered at EzyGuest’s discretion.

7.2 At the end of a free trial, your account may automatically convert to a paid plan unless cancelled prior to the trial end date.

8. Intellectual Property

8.1 EzyGuest retains all rights, title, and interest in the platform, templates, branding, and underlying technology.

8.2 You retain ownership of your Host‑provided content.

8.3 By using the Services, you grant EzyGuest a non‑exclusive, worldwide, royalty‑free licence to host, reproduce, and display your content solely for the purpose of providing the Services.

9. Third‑Party Services

9.1 The Services may integrate with or rely on third‑party services.

9.2 EzyGuest is not responsible for the availability, performance, or terms of any third‑party service.

10. Privacy and Data

10.1 Our collection and use of personal information is governed by our Privacy Policy.

10.2 You warrant that you have the right to provide any personal data you upload and that you have obtained all required consents from guests.

11. Disclaimers

11.1 The Services are provided on an “as is” and “as available” basis.

11.2 To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non‑infringement.

11.3 We do not guarantee that the Services will be uninterrupted, error‑free, or meet your specific needs.

12. Limitation of Liability

12.1 To the maximum extent permitted by law, EzyGuest is not liable for any indirect, incidental, special, or consequential loss, including loss of profits, data, or goodwill.

12.2 Our total liability to you for any claim arising out of or relating to the Services is limited to the amount you paid to EzyGuest in the 12 months preceding the claim. 12.3 Nothing in these Terms excludes consumer guarantees that cannot be excluded under Australian Consumer Law.

13. Indemnity

You agree to indemnify and hold harmless EzyGuest from any claims, damages, losses, or expenses arising from: – your use of the Services; – your content; – your breach of these Terms; – disputes with guests or third parties.

14. Termination

14.1 You may cancel your account at any time via your account settings.

14.2 We may suspend or terminate your account if you breach these Terms or misuse the Services.

14.3 Upon termination, access to your guest guides may be removed, subject to applicable law.

15. Governing Law

These Terms are governed by the laws of New South Wales, Australia, and the parties submit to the exclusive jurisdiction of its courts.

16. Changes to These Terms

We may update these Terms from time to time. Continued use of the Services after changes constitutes acceptance of the updated Terms.
